<p>Today we are going to go over some pointers on what to do when you are pulled over for a DUI.  While you might still get arrested for a DUI, following the following tips is essential to getting a lighter sentencing and having an easier time at the DMV during your license hearing.  During any interaction with the police, you should cooperate completely, simply because they have the authority to issue any sort of ticket they deem necessary.  This is especially true if you have been drinking, even if it was very little alcohol.  In the end, it is up to the officer&#8217;s judgement whether to arrest you, and should give them as little reason to do so as possible.  We very much hope that the following tips aid greatly in your experience with a police officer.</p>
<p>First and foremost, have all of your documents ready when they come to your car window.  You already know they are going to ask for your license, registration, and insurance, so have them at the ready.  It is a good idea to keep them all together in an easy-to-access place in your glovebox.  During a DUI stop, this is important because police officers can use you having difficulty getting your documents together as probable cause to check your blood alcohol level.   This is called &#8216;fumbling&#8217;.  If you have been drinking, it is likely that you will be brought into jail, but how you act in the first few minutes you are speaking with the officer will make a great deal of difference in how well you preserve your rights and how well your local criminal defense attorney can defend you.</p>
<p>Think carefully about what you say.  The officer may use your words against you.  Do not be lippy or defensive with the officer.  Any questions they ask you that might make you &#8216;admit guilt&#8217;, ie. how much you had to drink, where you were, if you ate, etc. are not questions that you have to answer.  Politely decline answering any of these questions.  If you have any diseases like diabetes, that might influence what is considered drunk driving, let the officer know at this time.</p>

Indeed, Colorado law prohibits people who are under the influence (either of drugs or alcohol) from taking taking control of any motor vehicle.  Commonly, a DUI is the result of being detained while having a blood alcohol level of more than .08 and DWI is having a blood alcohol level of between a .05 and a .08.  There may be a greater penalty for driving with a blood alcohol level that is greater than a .17.<br />
An interesting part of the law surrounding DUIs and DWIs is that, when you are pulled over and an officer asks you to take a blood or breath test, refusing to do so could cost you your license or be read as an admission of guilt.  Therefore, the law says that anyone who takes a test and &#8216;blows&#8217; a blood alcohol level that is a DUI has consented to do so.  However, the officer also has to have probable cause to ask someone to consent to one of these tests.  One of the more common ways to win a DUI case is to prove that the officer who detained the defendant did not have probable cause to ask them to take a breath test.<br />
There are serious criminal penalties and fines associated with DUIs and DWIs.  While receiving a DWI is a less serious offense than a DUI, one can still end up doing jail time, even for the first offense!  The criminal penalties for DUIs and DWIs get progressively more severe for repeat offenders.  For instance, jail time for one&#8217;s first DWI can range from about 2 days to (at the most) 180 days.  If the defendant has had two or more past driving under the influence or driving while impaired tickets, they can spend up to a year in jail, even with a DWAI, and end up doing 120 hours of community service.  The maximum fine for this crime is $1,500 dollars, but this does not include legal fees, court fees or any other fees associated with getting a DUI.  Remember to drive safely,  get a cab if you have had too much to drink, but if you need any help, please contact your local <a href="http://www.andersoncarnahan.com/" target="_blank">Colorado Springs Criminal Defense Attorney</a>, who can help you fight charges.<br />
